Terms of service

pbdevs.com is run by Filip Piątek and Jakub Bilski, working together as PB Devs. PB Devs is not a registered company; both of us provide the services as individuals, just as we are the data controllers in the privacy policy. Each order is handled by one of us, who is the party to the contract; the confirmation names him.

These terms cover the services you can use on the site without talking to us: the pricing calculator with the emailed summary, the contact form, ordering a website audit through the form on the Services page, and the chat, available after you agree to it in the privacy settings.

The rest of what we do (websites, stores, apps, systems, integrations, maintenance, implementing fixes after an audit) is agreed individually and covered by a separate proposal or contract. These terms do not replace it.

The calculator shows a starting amount for the chosen product type, features and timeline. The amount is indicative: it comes from a simple model that knows nothing about your project. The result is not an offer within the meaning of Article 66 of the Polish Civil Code and binds neither side. We give a binding amount after a free call and prototype, in a written proposal.

You can email yourself a summary of the estimate. Sending it requires an email address and an anti-bot check that your browser solves on its own. One email address can receive at most three summaries a day, and one IP address can send at most five messages per 10 minutes across all forms. Past the limit, the form returns an error. Calculating an estimate itself has no limit and needs no data.

Amounts on the site exclude VAT. We use the Polish VAT exemption for small businesses (Article 113(1) of the VAT Act), so no tax is added: the amount in the confirmation is the amount to pay. On request we issue an invoice without VAT.

We accept payment by bank transfer to the account given in the confirmation. We do not accept cash.

Sending the form does not create a contract. It is an enquiry, which we answer by email or phone within 24 hours on working days. The answer is not an offer unless we say so explicitly.

The chat answers questions about our services based on the content of the site. Its answers are informational and are neither an offer nor a quote. The conversation is processed as described in the privacy policy.

The audit is our only service with a price stated up front: the report costs 249 PLN and is ready within 2 working days of payment clearing. What the report contains and which areas it checks is described on the Services page; that description is part of the contract.

How an order works: you send the form with the site address, your name, email and any notes. Within 24 hours on working days we reply with a confirmation of scope, the price and bank transfer details. The contract is concluded when we send the confirmation; if we cannot take the order, we send a refusal instead. We start the audit once payment clears. If payment does not arrive within 14 days of the confirmation, the order lapses and has to be placed again. We deliver the report as a PDF to the email address you gave.

The audit covers the publicly accessible pages at the address you give. We do not need, and do not ask for, access to the server or the admin panel. By ordering, you confirm that you are entitled to have this site examined. The report describes the site as it was on the day of the check. We do not guarantee that implementing the fixes will produce any particular result in search engines or external tools. If the site is down or blocks the testing tools, we agree a new date or refund the payment.

The report is for you and your company. You may show it to your developer or agency. Do not resell it or publish it as your own analysis.

You use the calculator, the form and the chat without a fixed-term contract; you can stop at any time without giving notice.

You can cancel an audit order by email until we have started the check; we refund the full amount. After we have started, we charge proportionally for the part done, unless consumer law says otherwise. We may refuse to carry out an audit if the site breaks the law or you are not entitled to commission the check; we then refund the payment.

All you need is a current browser with JavaScript enabled and an email address. The calculator works without an account. Using the site costs nothing beyond your usual internet connection. The site may be briefly unavailable during server work; that takes minutes, not hours.

Do not use the forms or the chat to send unlawful content, including content that infringes other people's rights, or to send spam, circumvent security measures or commission an audit of a site you have no right to. Reports of such content: kontakt@pbdevs.com.

You can complain about a service from the site, including the audit, by email to kontakt@pbdevs.com. Say what it concerns and what you expect. We reply within 14 days of receipt. If a complaint about the audit is justified, we correct the report or refund the payment in full or in part.

Our services are aimed at businesses. If, however, you order an audit as a private individual or as a sole trader outside your own trade, you have consumer rights under Polish law: you may withdraw from the contract within 14 days of concluding it without giving a reason, by email to kontakt@pbdevs.com.

We start the audit before those 14 days have passed only at your express request, which you make by ticking the box "I want the audit to start as soon as payment clears" in the order form. By ticking it you acknowledge that once the audit has been delivered in full you lose the right to withdraw. If you withdraw part-way, you pay for the part done. Without the box ticked, we start the audit on the 15th day after the contract is concluded.

Consumers may also use out-of-court dispute resolution, for example through a municipal consumer ombudsman in Poland.

We are responsible for carrying out the audit as described on the site. We are not responsible for the consequences of changes you make to your site on the basis of the report, nor for the operation of the external tools the report relies on (Mozilla Observatory, SSL Labs, the W3C validator). Towards businesses our liability is limited to the amount paid for the service; towards consumers the general rules apply.

These terms may change, for example when the audit price changes. Orders placed before a change are handled under the old terms. The current version and the date of the last change are on this page; the terms can be saved and printed.

These terms are governed by Polish law. Disputes with businesses are heard by the court for our registered address; disputes with consumers by the court under the general rules.
